MIDNIGHT HIGH: VOICE OF MERCY ARG TERMS AND CONDITIONS

Welcome to the Midnight High: Voice of Mercy Alternate Reality Game (ARG). By signing up and participating in this experience, you agree to the following Terms and Conditions. If you do not agree, please do not participate.

1. ELIGIBILITY

  • Participants must be 18 years or older to sign up, as some locations may serve alcohol. Minors may participate with parental or guardian consent where applicable.

  • Participants must provide a valid email address to register for the experience.

2. PARTICIPATION AND CONDUCT

  • The Midnight High: Voice of Mercy ARG may involve real-world locations, including public parks, local monuments, and venues that serve alcohol.

  • Participants are expected to conduct themselves lawfully, respectfully, and responsibly while engaging in the ARG.

  • The experience may involve interactions with actors in public or private locations. Participants must respect actors, other participants, and members of the public at all times.

  • Any harassment, vandalism, trespassing, or illegal activities will result in immediate ineligibility from participation.

3. SAFETY AND LIABILITY DISCLAIMER

  • Participation in Midnight High: Voice of Mercy is at your own risk. The organizers are not responsible for any injury, illness, property damage, or legal consequences resulting from participation.

  • Participants should be aware of their surroundings and follow all local laws, safety guidelines, and venue regulations.

  • Any venues, businesses, or third-party locations visited during the game are not liable for any incidents related to the ARG.

  • If a participant feels unsafe or encounters an issue, they should exit the activity immediately.

4. PRIVACY POLICY

  • Participants’ email addresses and personal information will only be used for communication related to Midnight High and will not be shared with third parties.

  • Some interactions may be recorded for promotional purposes. By participating, you consent to the use of photographs or video footage featuring you in marketing materials.

5. User-Generated Content

  • Participant Submissions: By submitting any photos, images, or other content as part of the Midnight High: Voice of Mercy ARG, participants grant the organizers a non-exclusive, worldwide, royalty-free, and irrevocable license to use, modify, edit, reproduce, distribute, and display the submitted content for game-related and promotional purposes.

  • Editing and Distribution: Submitted images may be altered or edited to include in-game clues, aesthetic modifications, or other design elements before being shared on official social media accounts, websites, or other promotional materials.

  • Consent and Release: By submitting a photo, participants confirm they have the right to share the image and that it does not infringe on the rights of third parties. They also waive any claims related to the use of their submitted content.

  • Opt-Out Option: Participants who do not wish to have their images publicly shared may contact team@MidnightHTX.com to request removal or exclusion from promotional materials, though this may limit their participation in certain game elements.

6. MODIFICATION AND TERMINATION

  • The organizers reserve the right to modify, suspend, or terminate the ARG at any time.

  • These Terms and Conditions may be updated as needed, and participants will be notified of any significant changes.
